Coastal Pool Care Drivers Handbook
INTRODUCTION
This manual is the official statement of Coastal Pool Care policies. It is designed to provide managerial and supervisory staff with uniform knowledge in order to assure equitable and consistent application of these policies. It is the responsibility of each manager and supervisor to administer these policies consistently and impartially. The policies in this manual are applicable to all persons that drive or operate Coastal Pool Care owned or leased vehicles or equipment. This manual does not constitute an express or implied contract and its provisions are not intended to be contractually binding. Each employee has the right to end his or her employment with the Company at any time and for any reason and the Company reserves the same right. Coastal Pool Care reserves the right to change or amend these policies as it deems fit to ensure the safety of the public, our employees and resources.
USE OF COMPANY
VEHICLES
Only those employees whose names appear on the Coastal Pool Care’s list of authorized drivers and have a supervisor’s permission shall operate a company owned or leased vehicle. Company owned vehicles are to be used for company business only. Personal use of a company vehicle is prohibited unless approved by management. Company vehicles that are driven to and parked at employee’s residences or at a temporary lodging facility must be secured when not occupied and have contents
reasonably safeguarded.
(a) POLICY
Company vehicles are provided to support business activities and are
to be used only by qualified and authorized employees.
The purpose of this policy is to ensure the safety of those individuals who drive company vehicles. Vehicle accidents are costly to our company, but more importantly, they may result in injury to you or others. It is the driver’s responsibility to operate the vehicle in a safe manner and to drive defensively to prevent injuries and property damage. As such the Company endorses all applicable state motor vehicle regulations relating to driver responsibility. The Company expects each driver to drive in a safe and courteous manner pursuant to the following safety criteria. The attitude you take behind the wheel is the single most important factor in driving safely.
(b) DRIVER LICENSING
Coastal Pool Care drivers and anyone authorized to drive a company vehicle (rented, owned or leased) must have a valid driver’s license issued in the state of residence for the class of vehicle being operated and must be able to drive a vehicle. Obtaining a driver’s license is a personal expense.
(c) DRIVER ELIGIBILITY
Coastal Pool Care reserves the right to reject eligibility, or to restrict, suspend or terminate all driving privileges that it deems, in its sole discretion, would not be in the best interest of the company to protect the safety of both, our employees and the general public. Notwithstanding anything in this policy to the contrary, the Board of
Directors of Coastal Pool Care, in its sole discretion, reserves the right to grant or reject driver eligibility.
Any authorized or potentially authorized driver who’s Motor Vehicle Report shows
any one of the following records will not be eligible to drive a company vehicle.
(1) One or more Type “A” violation in the past three years.
(2) Any combination of accidents and Type “B” violations which equal three or
more within the last three years.
(3) A driver’s license that is currently suspended.
(d) VIOLATIONS
(1) Type A Violations:
i. Three or more “at fault” accidents while driving non-company
vehicles
ii. One “at fault” accident while driving a company vehicle
iii. Driving while intoxicated
iv. Driving under the influence of drugs
v. Negligent homicide arising out of the use of a motor vehicle (gross negligence)
vi. Using a motor vehicle for the commission of a felony
vii. Aggravated assault with a motor vehicle
viii. Operating a motor vehicle without the owner’s authority (grand theft)
ix. Permitting an unlicensed or unqualified person to drive
x. Speeding contest (racing)
xi. Hit and run driving (bodily injury or property damage)
xii. Reckless/careless driving
xiii. Operating a motor vehicle without a valid driver’s license
xiv. Operating a motor vehicle with passengers riding in truck beds, on tool boxes, or areas of the vehicle not specifically designed for the safe transport of passengers
xv. Carrying materials or tools without proper tie-down methods or materials
(2) Type B Violations:
i. All moving violations not classified as Type A violations
ii. Three or more Type C violations within the last three years equal 1 type B violation.
iii. A documented call-in complaint
(3) Type C Violations:
i. Any violation not classified as Type A or B violations
(e) REVIEW OF MOTOR VEHICLE RECORD
State Motor Vehicle Records (MVRs) will be used as the source for verifying driver history. MVRs will be obtained and reviewed at least annually. Driving privileges may be withdrawn or suspended and/or the company vehicles removed for any authorized driver not meeting the above requirements. In addition, appropriate disciplinary action may be taken.
(f) DRIVER RESPONSIBILITY
Each driver is responsible for the actual possession, care and use of the company vehicle in their possession. Therefore, the driver’s responsibilities include but are not limited to the following:
(1) Do not take chances! To arrive safely is more important than to arrive on time.
(2) The use of a company vehicle while under the influence of intoxicants and other drugs is forbidden and is sufficient cause for discipline,
including dismissal.
(3) No driver shall operate a company vehicle when his/her ability to do so safely has been impaired by illness, fatigue, injury, or prescription medication.
(4) Should an authorized driver be involved in an accident (regardless of severity) while operating a company vehicle and is found to be at fault, the driver’s privilege shall be revoked and/or suspended for a period not less than 3 years from the date of accident.
(5) Company vehicles are to be driven by authorized employees only, except in emergencies, or in case of repair testing by a mechanic. Spouses and other family members are not authorized to drive the company vehicle.
(6) Any employee who has a driver’s license revoked or suspended shall immediately notify their supervisor and the Safety Department, and discontinue operation of the company vehicle.
(7) All CDL drivers must comply with all applicable D.O.T. regulations, including successful completion of medical, drug, and alcohol evaluations.
(8) Authorized drivers are required to operate the vehicle in a manner consistent with reasonable practices that avoid abuse, theft, neglect or disrespect of the equipment.
(9) Any damage to a company vehicle shall be reported to Joe Brown within 24 hours. A written statement of how the damage occurred as well as photographs of the damage shall be required.
(10) Obey all traffic laws.
(11) Speed shall never be faster than a rate consistent with existing speed laws and road, traffic and weather conditions. Posted speed limits must be obeyed.
(12) Keep to the right except when overtaking slow moving vehicles, or when getting into a position to make a left turn.
(13) Never follow another vehicle so closely that you will not be able to make a safe stop under any conditions.
(14) Turn signals must be used to show where you are heading; when going into traffic and before every turn or lane change. Remember, signaling intentions neither gives the driver the right of way, nor guarantees a safe lane change.
(15) Slow down and watch for children in school zones.
(16) Before backing a vehicle, if another employee is available, he/she will be so stationed that he can warn the driver of approaching danger and assist him in maneuvering the vehicle.
(17) When parking a vehicle, the driver shall strive to back into the space, thus eliminating the danger of backing out into traffic.
(18) The use of seat belts and shoulder harness is mandatory for driver and passengers.
(19) Adhering to the manufacturer’s recommendations regarding service, maintenance and inspection. Vehicles shall not be operated with any defect that would prevent safe operation.
(20) Do not give rides to hitch-hikers or strangers.
(21) Drivers are responsible for the security of company vehicles assigned to them. The vehicle engine must be shut off, ignition keys removed, and vehicle doors locked whenever the vehicle is left unattended.
(22) Guns, firearms, and/or rifles are prohibited in the company vehicle.
(23) Vehicles with obstructed rear view such as flatbeds, Altecs, and mobile equipment, and those vehicles specifically designed for use as jobsite material handlers, shall be equipped with audible back-up alarms.
(24) Red flags, proper warning lights, or reflectors in accordance with legal requirements shall protect vehicles stopped on public roadways.
(25) Vehicles will not be parked on bridges or curbs except where necessary for work. If necessary, proper signaling devices and methods shall be used.
(26) Red flags during the day and red lights at night will be attached to equipment or material that extends more than 4’ from the back of the vehicle.
(27) Portable fuel containers shall be placed on the ground before filling.
(28) Riding in the bed or on the rear of a vehicle without approved seats and safety belts is strictly prohibited.
(29) The use of cell phones while driving a company vehicle is prohibited. Should an employee need to make/take a business call while driving, they should locate a lawfully designated area to park and make/take the call or use a hands-free speaking device such as a speakerphone or
earpiece.
(30) Texting, emailing, instant messaging, SMSing, etc. is strictly prohibited while operating a company vehicle.
Failure to comply with any of these responsibilities will result in
disciplinary action, including dismissal.
(g) MAINTENANCE
Authorized drivers are required to properly maintain their company vehicles at all times. Vehicles should not be operated with any defect that would inhibit safe operation during current and foreseeable weather and lighting conditions. Preventative maintenance such as regular oil changes, lubrication and tire pressure and fluid checks determine to a large extent whether you will have a
reliable, safe vehicle to drive and support work activities. You should have preventative maintenance completed on your vehicle as required in the owner’s manual. All questions and concerns about maintenance or defects should be referred to the office.
(h) TRAFFIC VIOLATIONS
Fines for parking or moving violations are the personal responsibility of the assigned operator. Coastal Pool Care will not condone nor excuse ignorance of traffic citations that result in court summons being directed to itself as owner of the vehicle. Each driver is required to report all moving violations to Joe Brown within 24 hours. This requirement applies to violations involving the use of any vehicle (company, personal or other) while on company business. Failure to report violations will result in appropriate disciplinary action. Please be aware that traffic violations incurred during non-business (personal
use) hours will affect your driving privileges as well and are subject to review.
(i) ACCIDENTS INVOLVING COMPANY VEHICLES
In the event of an accident:
(1) Call the police.
(2) Do not admit negligence or liability.
(3) Do not attempt settlement, regardless of how minor.
(4) Get name, address and phone number of injured person and witnesses, if possible.
(5) Exchange vehicle identification, insurance company name and policy numbers with the other driver.
(6) Take photograph of the scene of accident, if possible. (4 corner method)
(7) Complete the accident report in your vehicle.
(8) Turn all information (accident report, police report, written statements and pictures) to the Office within 24 hours.
(k) THEFT
In the event of theft of company vehicle or equipment store in/on a company vehicle:
(1) Notify local law enforcement immediately.
(2) Take photographs of the scene, if possible.
(3) Write a statement of what occurred.
(4) Turn all information (statement, police report and pictures) to the Office within 24 hours.
